                                      The humble petition on behalf of the above named 
                                      petitioner most respectfully,

S H E W E T H :
1.                 That this revisional application arises out of Judgment and Order dated 19.06.09 passed by the Joint District Judge, 2nd Court, Dhaka in Miscellaneous Case No. 8 of 2008 in which the learned Court allowed the Miscellaneous Case under Order- 9, Rule- 13 of CPC and the exparte decree was set aside.
2.                 That it is stated that the petitioner as plaintiff originally filed Money Suit No.2 of 2007 on 01.01.2007 in the Court of Joint District Judge, 2nd Court, Dhaka against the defendant. But as he did not contest the suit, the suit was decreed ex parte on 15.01.08.
3.                 That on 01.03.08 defendant- opposite party filed a Miscellaneous Case No.8 of 2008 under 2nd Court of Joint District Judge, Dhaka under Order-9, Rule-13 C.P.C for setting aside the ex-parte decree alleging that the summons was not duly served on him.
4.                 That  the plaintiff- petitioner contested the case by filling a written objection denying the material allegation in the application stating that the summons was duly served on the defendant through the manager of his factory, Mr. Ali.
5.                 That it is stated that after hearing the parties the Learned Trial Court on 19.06.09 was pleased to allow the Miscellaneous case and the ex-parte decree was set aside under Order-9, Rule-13 of C.P.C.
6.                 That being aggrieved by and dissatisfied with the judgment and Order of the learned trial court, the petitioner begs to move this application before your Lordships on the following amongst other,

G R O U N D S

I.                   For that the judgment and decree passed by the lower Appellate Court is bad in law as well as on facts.
II.                For that the learned Appellate Court below committed an error of law in setting aside the ex-parte decree without any basis in evidence on record.
III.             For that the trial court gave his judgement without taken into consideration the written objection filed by the plaintiff.
IV.            For that the Learned trial court failed to consider the fact that he failed to prove his allegation that the summons was not duly served on him and as such the judgment and order passed by both the Courts below are wholly illegal, malafide and as such liable to be set aside.

                                        Wherefore, it is most humbly prayed that your 
                                        Lordships would graciously be pleased to call for 
                                        the records, issue a Rule calling upon the 
                                        defendant-opposite party to show cause as to 
                                        why the Judgment and Order dated 19.06.09 
                                        passed by the Joint District Judge, 2nd Court, 
                                        Dhaka in Miscellaneous Case No. 8 of 2008 in 
                                        which the learned Court allowed the 
                                        Miscellaneous Case and the ex  parte decree was 
                                        set aside under Order-9, Rul-13 of CPC, and after  
                                        hearing the parties and cause shown, if any, 
                                        make the Rule absolute and/or pass such other 
                                        or further order or orders as to your Lordships 
                                        may seem fit and proper.

S H E W E T H :
1.         That this revisional application arises out of Judgment and decree dated 6.04.2011 passed by the District Judge, Sylhet in Civil Revision No.291 of 2011 in which the learned District Judge allowed the appeal on contest and thereby confirming the judgment and decree dated 6.11.2010 passed by the Assistant Judge, Sylhet in Title Suit No.98 of 2010 in which the learned Assistant Judge, decreed the suit on defendant’s favor.
2.        That it is stated that the petitioner as plaintiff filed a suit in the court of Assistant Judge, 1st Court, Sylhet as a Title Suit No. 98 of 2010 for a decree of perpetual injunction. But the opposite party filed an application for local investigation of the suit property and the learned court was pleased to allow the same.
3.        That being aggrieved by the order of the Court of Assistant Judge, Sylhet the plaintiff-petitioner filed an application before the Court of District Judge, Sylhet but the learned trial court was pleased to reject the same by affirming the order of the Assistant Judge without considering the facts and evidences, oral or documentary, provided by the plaintiff and therefore it is illegal, fraudulent, collusive and without jurisdiction.
4.        That it is stated that the learned trial Court without consideration of the facts and circumstances of the case decreed the suit in favor of the defendant.
5.            That it is submitted that the lower Appellate Court committed an error of law resulting in an error of decision occasioning failure of justice  and as such the judgment and decree passed by the lower Appellate Court is wholly illegal, malafide and as such liable to be set aside.
6.          That being aggrieved by and dissatisfied with the judgment and decree of the lower Appellate Court, the petitioner begs to move before your Lordships on the following amongst other,

G R O U N D S
I.           For that the judgment and decree passed by the lower Appellate Court is bad in law as well as in facts.
II.           For that the learned Appellate Court below committed an error of law in decreeing the suit on defendant’s favor without any basis in evidence on record.
III.         For that the plaintiff-respondent who is claiming injunction in respect of the suit land had only mentioned the khatian number and dag number and quantity of land but no boundary of the said land upon which the injunction had been sought by meets and bounds and it is a settle principle of law as stated in 55 DLR (HCD) P. 564 that in order to get an order of injunction the property in dispute should be clearly identified with specific area and demarcation and in the instant case both the Courts below had committed an error of law resulting in an error of decision by allowing an injunction in favour of the defendant and as such the judgment and order passed by  both the Courts below are liable to be set aside.
IV.       For that it is a settle principle of law that an injunction without previous notice to the opposite party is a deviation from the ordinary course of justice and should not issue without strong and grave reason as such the judgment and order passed by both the Courts below are wholly illegal, malafide and as such liable to be set aside.

              Wherefore,it is most humbly prayed that your  
              Lordships would graciously be pleased to call 
              for the records, grant leave for revision and 
              issue a Rule calling upon the defendant-
              opposite party to show cause as to why the 
              Judgment and decree dated 6.4.2011 passed    
              by the District Judge, Sylhet in Civil Revision 
              No.291 of 2011 in which the learned District 
              Judge allowed the appeal on contest and 
              thereby confirming the judgment and decree 
              dated 6.11.2010 passed by the Assistant 
              Judge, Sylhet in Title Suit No.98 of 2010 in 
              which the learned Assistant Judge, decreed 
              the suit on defendant’s favor, and after 
              hearing the parties, cause shown, if any, 
              make the Rule absolute and/or pass such 
              other or further order or orders as to your 
              Lordships may seem fit and proper.
                                  And
      
            Pending hearing of the Rule your Lordships    
            may kindly stay all further proceedings of the                
           Title Suit No.98 of 2010 now pending in the              
            Court of learned Assistant Judge.

REVISION

Revision-

Section 115 of the Code of Civil Procedure (here in after CPC), 1908 deals with 

the Revision. The two important areas from where questions might come in 

the exam is Section.115(1) and 115(4) of the CPC.

Section 115 (1) of the CPC states that, "The High Court Division may, on the 

application of any party aggrieved, call for the record of any suit or 

proceedings, in which a decree or an order has been passed by a Court of 

District Judge or Additional District Judge, or a decree has been passed by 

Court of Joint District Judge, Senior Assistant Judge or Assistant Judge, 

from which no appeal lies; and if such Court appears to have committed 

any error of law resulting in an error in such decree or order occasioning 

failure of justice, the High Court Division may, revise such decree or order 

and, make such order in the suit or proceedings, as it thinks fit."


[N.B.-On easy terms when a revision lies against an appeal then it will be 

dealt under this section [115(1) of CPC]. 


Section. 115 (4) of CPC States that "An application to the High Court 

Division for revision of an order of the District Judge or, Additional District 

Judge, as the case may be, made under sub-section (2) or (3) shall lie, 

where the High Court Division grants leave for revision on an (4) An 

application to the High Court Division for revision of an order of the District 

Judge or, Additional District Judge, as the case may be, made under sub-

section (2) or (3) shall lie, where the High Court Division grants leave for 

revision on an error of an important question of law resulting in erroneous 

decision occasioning failure of justice, and the High Court Division may 

make such order in the suit or proceeding as it thinks fit."

[N.B.- On easy terms sec.115(4) comes into action where a revision 

application needed to be filed against a revision.]

Note- Till now you must have observed that most of the grounds of the answers are same, this is because these are common grounds and can be used in any types of drafts. But this doesn't mean that when in real life you will get any case you gotta write only these points. No, then you will get lots of important and valid points to write. But for now, only for your convenience if you can't find out any other points then just remember these few points. So that you don't need to waste your time in the exam hall to find out valid points. Another important point is that if you get choice between an Appeal or a Revision. Please choose to write the Appeal. Because it will take less time and also an easy choice to go with. However, if you are confident enough (regarding answering Revision) then just go for it. REMEMBER ONE THING,YOU MIGHT NOT GET ANY CHOICE BETWEEN AN APPEAL AND REVISION, SO BE PREPARED TO ANSWER EITHER OF THEM.

IV.            For that the learned Joint District Judge failed to appreciate, assess the facts and circumstances of the case, materials on record in accordance with law.
  V.            For that the lower appellate Court had traveled beyond its jurisdiction by decreeing the suit and as such judgment and order passed by the Trial Court is wholly illegal, malafide and unsustainable in the eye of law.
VI.       For that the learned Joint District Judge without considering the facts and circumstances of the suit, exhibits and evidences on record on his own assumption found that the defendant could not prove the possession on the suit land and thereby committed miscarriage of justice in decreeing the suit not tenable in law.                                                                            
VII.   For that considering the facts and circumstances of the suit and materials on record the learned Joint District Judge ought to have decreed the suit on defendant’s favour.
VIII.            For that the learned trial court decreed the suit on the findings that the defendant could not prove his title, which is baseless and illegal.
IX.     For that the Learned Joint District Judge most illegally and arbitrarily gave stress upon the claim of the plaintiff overlooking on the facts and circumstances of the case and materials on record.
  X.     For that the learned Joint District Judge illegally based his findings in favour of the plaintiff in deciding the suit, based on assumption, contrary to the materials on record.
XI.    For that the Learned Joint District Judge failed to consider that the plaintiff succeeded to prove the case in accordance with law and hence the impugned Judgment and Decree is not tenable in law.
